1. Agreement to These Terms

These Terms and Conditions ("Terms") govern your access to and use of the Drawbee mobile application, website, and related services (collectively, the "Service") operated by Drawbee.

By creating an account, purchasing a subscription, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Drawbee.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use Drawbee. The Service is designed for parents and legal guardians who create and manage artist profiles on behalf of the people whose artwork is being saved.

You represent that the information you provide is accurate and that you have the authority to provide information about any artist profile you create.

3. Your Account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us promptly at support@drawbee.app if you suspect unauthorized access.

You may delete your account at any time in Settings. Account deletion is permanent and removes your account data from our systems, subject to limited retention described in our Privacy Policy.

4. Acceptable Use

You agree not to:

• use Drawbee for unlawful, harmful, or abusive purposes;
• upload content you do not have the right to use;
• attempt to access another user's account or private content without permission;
• interfere with or disrupt the Service, including by reverse engineering, scraping, or overloading our systems;
• use the Service to generate or distribute content that is illegal, exploitative, hateful, or otherwise inappropriate for a family product.

We may suspend or terminate access if you violate these Terms or if necessary to protect users or the Service.

5. Artist Profiles and User Content

You retain ownership of the drawings, photos, audio, and other content you upload ("User Content"). By uploading User Content, you grant Drawbee a limited license to host, process, display, and transform that content solely to operate the Service—including AI enhancement, animation, and story features you request.

Galleries are private by default. You control what you upload, save, share, or delete. You are responsible for ensuring you have any rights needed for the content you submit.

6. AI-Generated Content

Some features use artificial intelligence to enhance images, animate drawings, or generate stories. AI outputs are provided "as is" and may be imperfect, unexpected, or inconsistent. Drawbee does not guarantee that AI results will meet your expectations or be free from errors.

You are responsible for reviewing AI-generated content before sharing it outside the app.

7. Subscriptions and Purchases

Drawbee offers optional premium subscriptions and one-time purchases processed through the Apple App Store or Google Play via RevenueCat. Prices, billing periods, and features are shown in the app before purchase.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period through your App Store or Google Play account settings. Refunds are handled according to the policies of Apple or Google, not directly by Drawbee.

We may change pricing or features with reasonable notice where required by applicable law or platform rules.

8. Intellectual Property

Drawbee and its logos, design, software, and branding are owned by Drawbee or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

9. Privacy

Your use of Drawbee is also governed by our Privacy Policy, which explains how we collect and use personal information. The Privacy Policy is incorporated into these Terms by reference.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. DRAWBEE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DRAWBEE AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO DRAWBEE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) EUR 50.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Drawbee from claims, damages, losses, and expenses arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

13. Termination

You may stop using Drawbee at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if necessary to protect the Service or other users. Upon termination, provisions that by their nature should survive will remain in effect.

14. Governing Law and Disputes

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence provide otherwise.

If you are a consumer in the European Union, you may also bring claims in the courts of your country of residence. Before filing a claim, we encourage you to contact us at support@drawbee.app so we can try to resolve the issue informally.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the date at the top of this page and, where appropriate, provide notice in the app. Continued use after changes become effective constitutes acceptance of the updated Terms.
